Usage Statement

Application Scope

This License Agreement ("Agreement") is a legal agreement between you (an individual or a business entity) and Huawei Technologies Co., Ltd., including its subsidiaries ("Huawei") for the non-exclusive use of the Kunpeng DevKit ("DevKit") on Kunpeng hardware in the People's Republic of China. By downloading, installing, or using the DevKit, you acknowledge that you have read the terms and conditions set out in this Agreement, and agree to be legally bound by this Agreement. If you do not agree to this Agreement or you do not have the authority to agree to this Agreement, do not install or use the DevKit. This Agreement does not apply to the open source software included in the DevKit.

Definitions

• To prevent impact on services in the production environment, it is recommended that you use this tool in a non-production environment.
• The user names and passwords that are not used for the authentication of the tool will not be used for other purposes or saved in the system.
• You have confirmed that you are the owner of the application or have obtained authorization and consent from the owner before analyzing or operating the application.
• The analysis result may contain the internal information and related data of the application you analyze. Please manage the analysis result properly.
• Before using the Kunpeng DevKit to upload and view code, ensure that you are the code owner or authorized user. Otherwise, you shall bear all consequences incurred therefrom, and Huawei will not bear any legal liabilities.
• Reference codes, porting reports, precheck reports, and porting suggestions (collectively referred to as "the reports") generated by the Kunpeng Porting Advisor are for your reference only and do not have legal effect or constitute specific guidelines or legal suggestions in any way or form.
• When using the Kunpeng Porting Advisor, clicking OK will upload the code to the working directory of the server that you configure for code scan and analysis. This tool does not use the source code for any other purposes. Users who log in to the same server using other user names do not have the permission to view the code in your working directory.
• Unless otherwise specified in laws and regulations or contracts, Huawei does not make any explicit or implied statement or warranty on the porting suggestions or related content, or make any warranty or commitment on the marketability, satisfaction, non-infringement, or applicability of the porting suggestions or related content for specific purposes.
• Any behavior you take in accordance with the reports shall be at your own risk. Huawei is not liable for any direct, indirect, incidental, consequence, special or other loss or damage arising out of or in connection with the use of the reports.
• When using the Kunpeng Compiler and Debugger, you are responsible for the execution results of the compilation commands that you input.
• When using the Kunpeng Compiler and Debugger, the register values and local variables in the debugging information can be modified. You are responsible for the impact of the modification.
• When you use the Kunpeng Development Framework Plugin to deploy the SDK offline, the SDK installation package is uploaded to the workspace of the target server for SDK installation only. After the installation is complete, the installation package is automatically deleted and will not be used for other purposes. The project code snippet is open source code. Use it based on the corresponding open source license.
• Unless otherwise specified in laws and regulations or contracts, Huawei does not make any express or implied statement or warranty on the analysis result, or make any warranty or commitment on the marketability, satisfaction, non-infringement, or applicability of the analysis result for specific purposes.
• Any actions you take based on the analysis records shall comply with laws and regulations, and you shall bear the risks.
• No individual or organization may use the application or associated analysis records for any activity without the authorization of the owner. Huawei is not liable for any consequences and bears no legal liabilities. Huawei reserves the right to pursue legal actions if necessary.
• Huawei is not liable, directly or indirectly, for any damage or incidental, consequence, special or other loss caused or alleged to be caused by or in connection with use of or reliance of the tools under this Statement. The above losses or damages include but are not limited to any of the following loss or damage foreseen, foreseeable, known or otherwise: (i) income; (ii) actual or anticipated profits; (iii) use of currency; (iv) expected savings; (v) business; (vi) opportunities; (vii) goodwill; (viii) software use; (ix) damage to reputation; (x) data corruption; or (xi) any consequential, incidental, or special damage and loss.
• Unless otherwise specified by laws, Huawei does not guarantee that the tools run in an uninterrupted or error-free manner, or that Huawei will test and correct all errors.
